Introduction and acceptance These Terms of Use (the "Terms") govern your access to and use of the website published at plakar.io and its subdomains, together with the content, documentation, downloads, and online services made available through it (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site. These Terms apply to everyone who interacts with the Site, including visitors, readers of the documentation, users who download the open-source toolchain, and anyone who signs up for a trial or for Plakar Control Plane. ## 2. If you are a customer who has entered into a signed agreement with Plakar (for example, an Order Form together with our General Terms), that signed agreement governs your use of our software and services. In the event of any conflict or inconsistency between these Terms and your signed agreement, the signed agreement prevails. Our core open-source software (the plakar toolchain) is distributed under the ISC License. Individual components may be distributed under their own open-source licenses. In each case, your rights to use, copy, modify, and redistribute the software are defined by the license accompanying that software and not by these Terms. ## 4. Use of the Site You agree to use the Site lawfully and not to: - disrupt, damage, or impair the Site or the servers and networks that support it; - attempt to gain unauthorized access to any part of the Site, accounts, or systems; - introduce viruses, malware, or any other harmful code; - scrape, harvest, or collect data from the Site by automated means in a way that places an unreasonable load on our infrastructure or that breaches applicable law; - use the Site to infringe the rights of others or for any unlawful purpose. We may suspend or restrict access to the Site, in whole or in part, if we reasonably believe your use breaches these Terms or threatens the security or availability of the Site. ## 5. Open-source software and downloads Software made available for download through the Site is provided under its accompanying open-source license (such as the ISC License for the plakar toolchain) and is provided "as is", without warranty of any kind, to the fullest extent permitted by applicable law. You are responsible for determining whether the software is suitable for your environment and for the results of using it. ## 6. Accounts, trials, and Plakar Control Plane Some services offered through the Site, such as trials or Plakar Control Plane, require you to create an account. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Access to paid services is governed by the applicable subscription terms or by your signed agreement with Plakar, which prevail over these Terms as set out in section 3. ## 7. Intellectual property The Site and its content, including text, graphics, logos, layout, and the Plakar name and marks, are owned by Plakar or its licensors and are protected by intellectual property laws. Except as expressly permitted by these Terms, by a separate agreement, or by the applicable open-source license, you may not reproduce, distribute, modify, or create derivative works from the Site or its content without our prior written consent. Nothing in this section limits the rights granted to you under the open-source license applicable to our software. ## 8. Third-party links and services The Site may contain links to third-party websites or services that are not operated by us. We provide these links for convenience and do not control, endorse, or accept responsibility for their content, products, or practices. Your use of any third-party site or service is subject to that third party's own terms. ## 9. Disclaimers The Site is provided "as is" and "as available". To the fullest extent permitted by applicable law, we do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, nor that the content of the Site is complete, accurate, or up to date. For customers with a signed agreement, the liability provisions of that agreement govern our respective liabilities in relation to our software and services, and prevail over this section as set out in section 3. ## 11. Personal data We process personal data in accordance with the applicable regulations on the protection of personal data, including Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978.
